General conditions

  1. Payment

By signing this agreement, or by online registration and/or place reservation through Y-Liman's website, the student declares to have read and accepted the general terms and conditions of the Y-Liman driving school.

All training and exam reservations must be paid in advance of the training. This can be done by bank transfer, credit card, bancontact or cash in our offices. As for practical lessons, if the student does not take the wheel during movements on public roads, those movements will not be taken into account for calculating the number of hours of lessons. However, a demonstration by the teacher of a movement to be performed is part of the lesson and does not fall under the application of this rule. No services other than those for which a rate is specified in the contract may be charged. (RD 11/04/2004 _ Recognition of driving schools).

Certificates for the collection of the (provisional) driving license will be issued only after full payment of the tuition fees.

REMEMBER: For each driving exam, the exam fee, €40.00, must be paid at the exam center. This amount is settled through the driving school and therefore must be paid before the start of the driving test.

  1. Non-payment

Non-payment or late payment of the invoice gives rise, ipso jure and without prior notice, to a lump-sum increase of 20% of the amount due, in addition to the charging of statutory interest on arrears. Late payment also voids the guarantee of the appointments/dates made. Unless otherwise specified, all invoices are payable no later than 10 working days prior to the start of the scheduled training. Failure to pay an invoice no later than this due date shall render all outstanding amounts immediately due and payable, irrespective of pre-authorized payment terms.

  1. Cancellation of driving lessons, theory lessons, exam guidance

In case of cancellation or rescheduling of driving lessons and theory lessons up to 5 working days and an exam guidance up to 8 working days in advance, there is no charge. In case of cancellation or rescheduling at shorter notice, full tuition is due. In case of force majeure, and this is proven (e.g. via a doctor's certificate), only half of the tuition will be charged. However, in case of cancellation or rescheduling at short notice, the examination fees are due in full since Y-Liman Driving School still owes them to the examination center. Exception: if a duo course is cancelled, the full tuition fee is always due, regardless of the cancellation period.

Y-Liman Driving School has the right to reschedule or cancel lessons and training in the event of force majeure (illness of the instructor, vehicle breakdown, weather conditions, additional exams, etc.) without giving rise to any right to compensation on the part of the student. A replacement lesson/training will always be provided.

  1. Certificate of Competence

 No aptitude certificate will be issued by the driving school if the instructor judges that the student is not competent to continue the training on public roads without a guide. During the foreseen evaluation moments, the instructor will discuss the progress in the learning process with the student. For a certificate of competence, the student must have effectively followed a minimum of 20 hours of lessons.

  1.  Student obligations
  2. Training courses (including additional tuition) can only be booked on the website www.y-liman.com or at our offices. Booking directly with the instructor is not permitted.
  3. The student is always obliged to report all relevant information regarding his provisional driving license (in particular theoretical exam, number of exam attempts and whether or not he already has a provisional driving license in the past) to Y-Liman Driving School upon registration.
  4. If the student does not show up for the exam or shows up late due to causes attributable to him, he must pay all costs of the practical exam (exam guidance and exam center surcharge).
  5. If the exam does not take place because the student could not present the appropriate valid documents (e.g. valid provisional driver's license, identity card, attestation of municipal administration , attestation of passing theory,…), then he will have to pay all the costs of the practical exam (exam guidance and surcharge of the exam center).
  6. The student is required to be present in class on time. If the student arrives later than 15 minutes to a training course, the teacher has the right not to admit the student to the course. Leaving a course early is considered as being absent. No certificate will be issued or registration performed in this case.
  7. Smoking is prohibited in the classroom vehicles. Driving with high heels is not allowed. In case the lesson cannot take place or is delayed because of this, the lesson fees will be charged.
  8. The student should refrain from drug or alcohol use during class. A suspicion of alcohol use and or drugs at the start or during the theory or practical training may be cause for mandatory withdrawal from the course. The full tuition fee will remain due if applicable.
  9. During the driving test, the student himself is responsible for traffic violations and the resulting fines, the instructor cannot then intervene without negatively affecting the exam evaluation.
  10. Responsibility Y-Liman Driving School
  11. Y-Liman Driving School cannot be held responsible if the student is refused at the exam center due to administrative problems or incorrect information.
  12. Y-Liman Driving School cannot be held responsible for changes in training or examination regulations due to changing legislation.
  13. Y-Liman-Rijschool makes great efforts so that the information made available is complete and correct. Despite these efforts, errors may occur. Y-Liman-Rijschool cannot be held liable for direct or indirect damages resulting from the use of the information made available. Errors or inaccuracies can always be reported in writing or by e-mail.
  14. Each Y-Liman Driving School lesson vehicle is covered by an insurance policy for: • The civil liability of the student, as driver and as passenger. • The damage caused, under any circumstances, during and by the use of this lesson vehicle to the student or his property. This policy provides that the insurer (except in cases of gross negligence or willful misconduct) waives any recourse against the student. The coverage of the damage to the property of the student is unlimited (RD 11/05/2004 Recognition of driving schools. Art. 19).

Any damage caused with the student's own vehicle is not covered by any driving school insurance policy.

  1. Complaints

The student should write to the Y-Liman-Rijschool management at the following address: Y-Liman-Rijschool bv, turnhoutsebaan 89, 2140 brorgerhout or via e-mail: info@y-liman.com Except in cases of force majeure, complaints must reach Y-Liman-Rijschool no later than 8 days after the services provided.

  1. Personal data

At Y-Liman Driving School, we attach great importance to the protection of the personal data we collect. We handle and secure this data with the utmost care, in accordance with applicable legislation in Belgium. We make every effort to protect the personal data provided to us from loss, destruction, disclosure, unauthorized access or improper use.

We collect your data when you enter or leave your details on our website or on EEn of our IT applications/tools, when you register in EEn of our offices to want to use our services.

We collect your personal data for the purposes listed below and will not use this data for other purposes without notifying you in advance and, if necessary, seeking your consent to do so.

More specifically, we use your personal data to, as appropriate:

-giving you information about possible lessons (theory/practice), exams

-to register for an enrolled class, exam

-at the request of government agencies during inspections;

-imposed by law, court order or judgment;

We process the personal data necessary for our services. These include your first name, name, address, date of birth, and cell phone number, e-mail address, gender, marital status, national registration number, ID card number. In case of taking photos, a separate photo agreement will be concluded with you.

Your personal data will not be transferred outside of Belgium.

We guarantee not to keep your data longer than required by law or internal regulations applicable within our company.

Y-Liman Driving School makes every effort to optimally secure your personal data against unauthorized use. We do this by means of physical, administrative and technological measures.

You can exercise the following rights:

-right to refuse or withdraw your consent

We will not process your data if you do not give us permission to use your personal data to guide you to work, but then you will also not be able to use the services of the Y-Liman Driving School.

-right of objection

You can oppose the processing of your personal data. You can only do this against processing that is done on the basis of the legitimate interests of Y-Liman Driving School or a third party. When exercising this right, you will have to indicate your e-mail exactly which processing you are objecting to and for what specific reasons. This is necessary in order to carry out a proper balancing of interests.

-right of Inspection

You can ask for a ruling on whether or not your personal data are being processed.

If this is the case, you may request the following information: the purposes of the processing, the categories of personal data we hold about you, the categories of recipients (third countries or international organizations), the retention period and or criteria for determining it, your other rights, other sources of origin of your data and the existence of automated decision making. In providing this information, we must always take into account the rights and freedoms of other persons.

-right to rectification (correction and addition)

You can ask to correct or complete any (personal) data that you consider incorrect or incomplete. In exercising this right you will have to specify in the form exactly which data you wish to correct or supplement.

Incorrect objective personal data (e.g. wrong spelling of your name, wrong address, etc.) will always be corrected as requested.

-right to portability

You have the right to have Y-Liman Driving School transfer, in electronic form, the personal data that you yourself have provided to Y-Liman Driving School to yourself (via your e -mail address that you provide in your application form) or to another controller designated by you (via its e-mail address that you provide in your e-mail).

-right to data erasure (oblivion)

Your records at Y-Liman Driving School will be deleted.

-right to restrict processing

You have the right to have the processing of your personal data restricted when:

-you dispute the accuracy of your personal data (for the duration of the check by Y-Liman Driving School);

-the processing of your personal data by Y-Liman Driving School would be unlawful but you still do not wish to exercise your right to data erasure;

-we no longer need your personal data for the purposes set forth in this privacy statement.

In principle, you can exercise your rights free of charge. You can do this by sending an e-mail to info@y-liman.com. At the latest within one month after receipt of your e-mail we will inform you in writing about the action we have taken on your request. Depending on the difficulty of your request or the number of requests we receive from other people, this period can be extended by two months. In this case, we will notify you of this extension within one month of receiving your e-mail.

In some cases (e.g. legal obligations, rights of other persons, limitation periods, ...) you will not be able to exercise your rights in full. You will be notified of this with the reasons why we cannot, or cannot fully, fulfill your request.

  1. Belgian law

Only Belgian law applies to all contracts with the student. In case of dispute, the parties shall apply to the competent courts of the registered office of the Y-Liman Driving School, unless a party requests in advance the Institute of Arbitration (www.euro-arbitration.org) to form an arbitral tribunal with ONE or three arbitrators, to be chosen from the tableau of www.arbiters.be. The arbitral tribunal will apply the Standard Dispute Rules of the Institute of Arbitration. This agreement supersedes all jurisdictional clauses in conflict with it.
