Terms and Conditions

  1. Payment

By signing this agreement, or by registering online and/or reserving a spot via the Y-Liman website, the student confirms that they have read and accept the terms and conditions of the Y-Liman driving school.

All training courses and exam reservations must be paid for before the course begins. Payment can be made by bank transfer, credit card, Bancontact, or in cash at our offices. Regarding practical lessons: if the student does not take the wheel during trips on public roads, those trips will not be counted toward the total number of lesson hours. However, a demonstration by the instructor of a maneuver to be performed is part of the lesson and is not subject to this rule. No service other than those for which a rate is specified in the contract may be charged. (Royal Decree of April 11, 2004—Accreditation of Driving Schools).

Certificates required to pick up your (provisional) driver's license will only be issued after full payment of the tuition fees.

PLEASE NOTE: For each driving test, the exam fee of €40.00 must be paid at the test center. This amount has been settled through the driving school and must therefore be paid before the start of the driving test.

  1. Non-payment

Failure to pay or late payment of an invoice shall, by operation of law and without prior notice of default, result in a fixed surcharge of 20% of the amount due, in addition to the statutory default interest. In the event of late payment, the guarantee of the agreed terms/dates shall also lapse. Unless otherwise specified, all invoices must be paid no later than 10 business days prior to the start of the scheduled training. Failure to pay an invoice by this due date shall render all outstanding amounts immediately due and payable, regardless of any previously agreed payment terms.

  1. Cancellation of driving lessons, theory lessons, and exam preparation

If driving lessons and theory lessons are canceled or rescheduled up to 5 business days in advance, and exam coaching up to 8 business days in advance, no fees will be charged. In the event of cancellation or rescheduling at shorter notice, the full lesson fee is due. In cases of force majeure, provided this is substantiated (e.g., via a doctor’s note), only half of the lesson fee will be charged. However, if you cancel or reschedule at shorter notice, the exam fees are due in full, as Y-Liman Driving School remains liable to the exam center. Exception: if you cancel a duo course, the full tuition fee is always due, regardless of the cancellation period.

Y-Liman Driving School reserves the right to reschedule or cancel lessons or training sessions in the event of force majeure (instructor illness, vehicle breakdown, weather conditions, additional exams, etc.) without this giving rise to any right to compensation on the part of the student. A replacement lesson or training session will always be provided.

  1. Certificate of Competence

 The driving school will not issue a certificate of competence if the instructor determines that the student is not competent to continue training on public roads without supervision. During the scheduled evaluation sessions, the instructor will discuss the student’s progress in the learning process with the student. To receive a certificate of competence, the student must have completed at least 20 hours of instruction.

  1.  Student Responsibilities
  2. Courses (including additional class hours) can only be booked on the website www.y-liman.com or at our offices. It is not permitted to book directly with the instructor.
  3. The student is required to provide Y-Liman Driving School with all relevant information regarding their provisional driver’s license (specifically, the theory exam, the number of exam attempts, and whether or not they have held a provisional driver’s license in the past) at the time of registration.
  4. If the student fails to appear for the exam or arrives late for reasons attributable to him, he must pay all costs associated with the practical exam (exam supervision and the exam center’s fee).
  5. If the exam is canceled because the student was unable to present the required valid documents (e.g., a valid provisional driver’s license, ID card, certificate from the municipal government, certificate of passing the written exam, etc.), the student must pay all costs associated with the practical exam (exam supervision and the exam center’s fee).
  6. Students are required to arrive on time for class. If a student arrives more than 15 minutes late for a class, the instructor has the right to refuse admission to the course. Leaving a class early is considered an absence. In such cases, no certificate will be issued and no attendance will be recorded.
  7. Smoking is prohibited in the training vehicles. Wearing high heels is not permitted. If the lesson cannot take place or is delayed as a result, the lesson fees will still be charged.
  8. Students must refrain from using drugs or alcohol during class. Any suspicion of alcohol or drug use at the start of, or during, the theoretical or practical training may result in mandatory dismissal from the program. In such cases, the full tuition fee remains due.
  9. During the driving test, the student is personally responsible for any traffic violations and the resulting fines; the instructor cannot intervene without negatively affecting the test evaluation.
  10. Liability of Y-Liman Driving School
  11. Y-Liman Driving School cannot be held responsible if a student is denied entry to the testing center due to administrative issues or incorrect information.
  12. Y-Liman Driving School cannot be held responsible for changes to the training program or exam regulations resulting from changes in legislation.
  13. Y-Liman Driving School makes every effort to ensure that the information provided is complete and accurate. Despite these efforts, inaccuracies may occur. Y-Liman-Rijschool cannot be held liable for any direct or indirect damage resulting from the use of the information provided. Errors or inaccuracies may be reported at any time in writing or via email.
  14. Every Y-Liman Driving School training vehicle is covered by an insurance policy for: • The student’s civil liability, both as a driver and as a passenger. • Damage caused, under any circumstances, during and as a result of the use of this training vehicle to the student or their belongings. This policy stipulates that the insurer (except in cases of gross negligence or willful misconduct) waives any right of recourse against the student. Coverage for damage to the student’s belongings is unlimited.(Royal Decree of May 11, 2004, on the Accreditation of Driving Schools. Art. 19).

Any damage caused by the student’s own vehicle is not covered by the driving school’s insurance policy.

  1. Complaints

The student must submit a written complaint to the management of Y-Liman-Rijschool at the following address: Y-Liman-Rijschool bv, Turnhoutsebaan 89, 2140 Brorgerhout, or via email: info@y-liman.com. Except in cases of force majeure, complaints must be received by Y-Liman-Rijschool no later than 8 days after the services were provided.

  1. Personal data

At Y-Liman Driving School, we place great importance on protecting the personal data we collect. We handle and secure this data with the utmost care, in accordance with applicable Belgian law. We do everything in our power to protect the personal data provided to us against loss, destruction, disclosure, unauthorized access, or misuse.

We collect your information as soon as you enter or submit your details on our website or through one of our IT applications/tools, or when you register at one of our offices to use our services.

We collect your personal data for the purposes listed below and will not use this data for any other purposes without notifying you in advance and, if necessary, obtaining your consent.

More specifically, we use your personal data to, where applicable:

-to provide you with information about potential classes (theory/practical) and exams

- to register for a scheduled class or exam

-at the request of government agencies during inspections;

-required by law, court order, or judgment;

We process the personal data necessary to provide our services. This includes your first name, last name, address, date of birth, cell phone number, email address, gender, marital status, national identification number, and ID card number. If photographs are taken, a separate photography agreement will be entered into with you.

Your personal data will not be transferred outside of Belgium.

We guarantee that we will not retain your data for longer than required by law or by our company’s internal policies.

Y-Liman Driving School does everything in its power to ensure that your personal data is optimally protected against unauthorized use. We do this through physical, administrative, and technological measures.

You may exercise the following rights:

-Right to refuse or withdraw your consent

We will not process your data if you do not give us permission to use your personal data to assist you in finding employment; however, in that case, you will not be able to use the services of the Y-Liman Driving School.

-right to object

You have the right to object to the processing of your personal data. You may only do so with respect to processing carried out on the basis of the legitimate interests of Y-Liman-Rijschool or a third party. When exercising this right, you must specify in your email exactly which processing you are objecting to and the specific reasons for your objection. This is necessary to ensure that we can properly balance the interests involved.

-Right of Access

You may request confirmation as to whether or not your personal data is being processed.

If this is the case, you may request the following information: the purposes of processing, the categories of personal data we hold about you, the categories of recipients (third countries or international organizations), the retention period and the criteria used to determine it, your other rights, other sources of your data, and the existence of automated decision-making. When providing this information, we must always take into account the rights and freedoms of other individuals.

-Right to rectification (correction and supplementation)

You may request that any personal data you believe to be incorrect or incomplete be corrected or supplemented. When exercising this right, you must specify in the form exactly which data you wish to correct or supplement.

Incorrect personal information (e.g., misspelled name, incorrect address, etc.) will always be corrected as requested.

-right to portability

You have the right to request that Y-Liman Driving School transfer the personal data you have provided to it to you in electronic form (via the email address you provide in your request form) or to another data controller of your choice (via the email address you provide in your email).

-Right to erasure (right to be forgotten)

The information in your file at the Y-Liman Driving School will be deleted.

-Right to restriction of processing

You have the right to restrict the processing of your personal data when:

- you dispute the accuracy of your personal data (for the duration of Y-Liman-Rijschool’s review);

-the processing of your personal data by Y-Liman Driving School is unlawful, but you do not wish to exercise your right to erasure;

-we no longer need your personal data for the purposes described in this privacy statement.

In principle, you can exercise your rights free of charge. To do so, please send an email to info@y-liman.com. We will inform you in writing of the action we have taken in response to your request no later than one month after receiving your email. Depending on the complexity of your request or the number of requests we receive from other individuals, this period may be extended by two months. In this case, we will notify you of this extension within one month of receiving your email.

In some cases (e.g., legal obligations, the rights of others, statutes of limitations, etc.), you may not be able to exercise your rights, or may not be able to exercise them in full. In such cases, you will be notified of the reasons why we cannot comply with your request, or cannot comply with it in full.

  1. Belgian law

All contracts with the student are governed exclusively by Belgian law. In the event of a dispute, the parties shall bring the matter before the competent courts of the registered office of the Y-Liman Driving School, unless a party requests in advance that the Institute of Arbitration (www.euro-arbitration.org) form an arbitral tribunal consisting of one or three arbitrators, to be selected from the list at www.arbiters.be. The arbitral tribunal shall apply the Standard Dispute Rules of the Institute of Arbitration. This agreement supersedes all conflicting jurisdiction clauses.
